Any legal suit, action, or proceeding arising out of or related to these Terms and Conditions or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Colorado, in each case located in Denver County. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

17. DISPUTE RESOLUTION

Informal Resolution

Before filing a claim against us, you agree to try to resolve the dispute informally by contacting us at info@orpheuspcc.org. We’ll try to resolve the dispute by contacting you via email. If the dispute is not resolved within 30 days, you or we may bring a formal proceeding.

Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms and Conditions shall be settled by binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Denver, Colorado, and judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver

YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court.

18. SEVERABILITY

If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of the Terms and Conditions will continue in full force and effect.

MEADFEST CONTEST DISCLAIMER

Orpheus Pagan Chamber Choir is a 501(c)(3) nonprofit organization. Donations made through our Site are tax-deductible to the extent allowed by law. While we use reasonable efforts to ensure donations are used in accordance with donor intentions, we reserve the right to use unrestricted funds in the best interest of our organization. Donor recognition is displayed on our Site or in programs.
